TERMS OF SERVICE

Welcome to AWA ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the AWA platform at awa.events, including our website, mobile applications, APIs, and all related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, purchasing a ticket, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms.

2. Ticket Purchases

All ticket sales on the Platform are subject to the following conditions:

  • Non-refundable. All ticket purchases are final and non-refundable unless the event is cancelled by the promoter or organizer. In the event of cancellation, refunds will be processed at the discretion of the event organizer.
  • Non-transferable. Tickets are issued to the individual whose details are provided at purchase. Tickets may not be resold, transferred, or assigned to another person without the express written consent of the event organizer.
  • QR code entry. Each ticket is associated with a unique QR code that must be presented at the event venue for entry. Duplicated, altered, or fraudulent QR codes will result in denied entry without refund.
  • Pricing. All prices are displayed in the currency specified at checkout. AWA is not responsible for currency conversion fees charged by your payment provider.

3. User Accounts

To use certain features of the Platform, you must create an account. When creating an account, you agree to:

  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Provide accurate, current, and complete information during registration.
  • Maintain the security and confidentiality of your account credentials.
  • Accept responsibility for all activity that occurs under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms.

4. Promoter Terms

If you use the Platform as an event promoter or organizer, the following additional terms apply:

  • Platform fee. AWA charges a platform fee of 5% on all ticket sales processed through the Platform. This fee is automatically deducted before payouts.
  • Payouts. Net proceeds (after the platform fee) will be disbursed to your designated bank account within 14 business days following the conclusion of your event.
  • Event content. You are solely responsible for the accuracy of all event information, including dates, times, venues, and descriptions.
  • Compliance. You agree to comply with all applicable local laws, regulations, and venue requirements for your events.

5. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or related systems.
  • Distribute malware, viruses, or any other harmful software through the Platform.
  • Engage in ticket scalping, bot purchasing, or any form of automated ticket acquisition.
  • Impersonate another person or entity, or falsely represent your affiliation.
  • Scrape, harvest, or collect data from the Platform without our express written consent.
  • Interfere with or disrupt the integrity or performance of the Platform.

6. Limitation of Liability

To the fullest extent permitted by law, AWA and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform.

AWA acts as a technology platform connecting event organizers with attendees. We are not the organizer of any event listed on the Platform and do not guarantee the quality, safety, or legality of any event. Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Jamaica.
